DELIVERY AND PICK UP:

Lessee grants Lessor the right to enter their location for delivery and return of equipment. All payments must be made at time of delivery.

ELECTRICAL SERVICE:

Lessee must furnish an electrical outlet rated at 115 volts with a SLO-BLO 20-amp fuse or 30-amp fuse capacity located with in 50 feet of each unit, without anything else connected. Use only the ONE extension cord provided per motor. Using longer extension cords could burn the motor out due to low voltage when longer extension cords are used. Voltage at motor must be 110 volts.
Lessee has sole responsibility for hook up to a proper outlet as described above. There is a $50.00 "trip" charge to return for blown breakers.

SET UP:

Texas Party Jumps products must be used over a smooth, compatible surface such as grass or a hard top surface. The unit may NOT be operated on rough surfaces such as, rocks, bricks, glass or jagged objects. The unit POSITIVELY may NOT be located next to any wall, pole, tree limbs or any fixed object: a minimum of 4 feet clearance on all sides must be observed at all times. Equipment must be anchored to the ground.

OPERATION:

Adult supervision is required at all times. Observe rules posted on unit or on the back of the legal contract. Compatible age groups must play on equipment at a time. Age groups must not be mixed. The maximum number of customers of each age group that play at one time is:

All persons must remove shoes and any sharp objects before playing in or on the inflated Amusement ride: Absolutely no water of any kind may be used on, in or around the unit, including clothing. There will be an additional $50.00 cleaning charge for units that are wet when picked up.
Texas Party Jumps assumes NO responsibility for the breakage of any under ground plumbing. It is the responsibility of the lessee to show lessor where any plumbing or wiring under ground may be located.

TERMS OF LEASE:

The lessee or using party shall be in charge of operation, and are fully responsible for there operation after receiving the unit: Lessor is not responsible for any injuries occurring to lessee or to any persons using the leased units or equipment or any damage to any personal property.

Lessee further agrees to hold Lessor free and harmless against any claims: and further, Lessor shall be indemnified for any and all cost incurred due to claims from any one; including court cost and attorney's fees, and other related cost involving the use of the leased units and or equipment.

Lessee shall provide their own liability insurance, unless otherwise specified. Lessee is responsible for the replacement cost of the new leased units and or equipment in the event of theft, vandalism, fire or any act which may damage or destroy the leased units or equipment.

Failure to make available for pickup, units or equipment delivered to lessee, or failure to return leased units or equipment as agreed to in this contract, shall make lessee liable and responsible to lessor for an additional "one day rental fee" per day until all units or equipment,is returned to Texas Party Jumps, or satisfactory arrangements is made, in writing with Lessor. If Lessee fails to abide by the conditions of this agreement, lessee must reimburse Lessor for all court and/or attorney fees incurred by Lessor to enforce this contract.

PAYMENT, USE AND CHECK POLICY:

If it determined by Lessor that payment has not been received or that Lessor's equipment is not being operated safely as per terms of this agreement, then pickup or return time is no longer applicable, all units and equipment immediately due to be returned to Lessor. Some rentals may be paid by check WITH PREVIOUS ARRANGEMENT and proper identification. If bank returns check unpaid, the Lessee must pay cash, the amount of the check plus a $25.00 fee at Lessor's office address within two days. Unpaid checks will be referred to an attorney for collection with additional $50.00 cost plus any and all legal fees incurred collecting said unpaid checks.

RAIN POLICY:

Lessee may cancel rental at any time prior to receiving units and or equipment at their option, due to inclement weather. If customer (Lessee) receives the leased units and or equipment, Lessors obligation to furnish has been met and no rain checks will be available.

POLICY FOR WET WEATHER FORECAST:

( i.e. POSSIBLE RAINY DAYS ) CUSTOMER (LESSEE) PAY FOR UNIT ONCE THEY ACCEPT IT.
